According to Article 32 of the Customs Law of the People’s Republic of China, the storage, processing, assembly, display, transportation and consignment business of bonded goods and the operation of duty-free shops shall meet the requirements of customs control, be approved by the Customs and go through registration formalities. Relevant formalities shall be completed with the Customs for the transfer, transfer and entry and exit of bonded goods into and out of bonded places, and they shall be subject to customs control and examination.

I. Conditions for the establishment of bonded logistics center (Type B)

? ? ? ? The establishment of a bonded logistics center (Type B) shall meet the following conditions:

? ? ? ? I. Bonded logistics center (Type B) storage area: not less than 50,000 square meters in the eastern region, not less than 20,000 square meters in the central and western regions and northeast regions;

? ? ? ? II. Meet the requirements of customs supervision and planning for bonded logistics center (Type B);

? ? ? ? III. The site should be located near seaports, airports, land transportation hubs and places with large demand for inland international logistics, convenient transportation, and customs institutions and centralized supervision by the customs;

? ? ? ? IV. Confirmed by provincial people’s government, it conforms to the overall layout of local economic development and meets the demand of bonded logistics for the development of processing trade;

? ? ? ? V. Set up to meet the requirements of customs control computer management system, provide for the customs inspection of the data terminal equipment, and according to the regulations of the customs of authentication and data standard, through the “China electronic port” networking platform with customs, so that the customs on the unified platform and national tax, foreign exchange management department to realize data exchange and information sharing;

? ? ? ? VI. Set up isolation facilities, supervision facilities and other facilities necessary for handling business in accordance with the requirements of customs supervision.

II. Qualification requirements for the operation enterprise of bonded logistics center (Type B)

? ? ? ? An enterprise operating a bonded logistics center (Type B) shall meet the following qualifications:

? ? ? ? I. Registered by the administrative department of industry and commerce, with the qualification of independent enterprise legal person;

? ? ? ? II. Capable of daily management of enterprises in bonded logistics center (Type B);

? ? ? ? III. Have the ability to assist the customs to supervise the goods entering and leaving the bonded logistics center (Type B) and the business behavior of enterprises in the bonded logistics center (Type B).

III. Materials required for the application of “Approval of establishment of Bonded Logistics Center (Type B)

? ? ? ? Initial applications are required to provide:

? ? ? ? I. Application for the establishment of bonded Logistics Center (Type B);

? ? ? ? II. The legal certificate of land use right and the geographical location and plane plan of the bonded logistics center (type B).

IV. Procedures for approval of establishment of “Bonded Logistics Center (Type B)

? ? ? ? The procedures of bonded logistics center (Type B) are divided into application, acceptance, examination and decision.

? ? ? ? The process is as follows:

? ? ? ? I. The application for the establishment of bonded logistics center (Type B) shall be accepted by the directly affiliated Customs and reported to the General Administration of Customs for approval;

? ? ? ? II. Upon receipt of the application, the General Administration of Customs shall put forward its handling opinions and forward them to the Ministry of Finance, the State Administration of Taxation and the State Administration of Foreign Exchange for joint examination and approval by the four departments after reaching consensus;

? ? ? ? III. The enterprise shall apply to the General Administration of Customs for acceptance inspection within 1 year from the date of issuance of the document approving the establishment of the Bonded logistics center (Type B) by the General Administration of Customs, and the General Administration of Customs shall conduct inspection and acceptance inspection jointly with the Ministry of Finance, the State Administration of Taxation, the State Administration of Foreign Exchange and other departments or entrust and authorized institutions according to the provisions of these Measures;

? ? ? ? IV. After the bonded Logistics Center (Type B) passes the inspection, the General Administration of Customs shall issue the Registration Certificate of Bonded Logistics Center (Type B) to the enterprises operating the logistics center;

? ? ? ? V. If an enterprise approved to set up a bonded logistics center (Type B) does not apply for acceptance inspection on time for legitimate reasons, the acceptance inspection may be postponed with the approval of the General Administration of Customs. An enterprise approved to establish a bonded logistics center (Type B) shall be deemed to have withdrawn its application for establishing a bonded logistics center (Type B) if it fails to apply for acceptance inspection within the prescribed time limit or fails to pass the acceptance inspection without justifiable reasons.

V. Continuation process and validity period of bonded logistics center (Type B)

? ? ? ? The certificate of Registration of Bonded Logistics Center (Type B) is valid for 3 years.

For extension, please note:

? ? ? ? I. If an enterprise operating bonded Logistics Center (Type B) applies for extension, it shall handle the extension formalities 30 days prior to the expiration of the Registration Certificate of Bonded Logistics Center (Type B) (except force majeure), which shall be accepted by the directly affiliated Customs and entrusted by the General Administration of Customs for examination and approval;

? ? ? ? II. The directly affiliated Customs will grant an extension of 3 years to the qualified enterprises operating bonded Logistics Center (Type B), and report to the General Administration of Customs to renew or endorse the Registration Certificate of Bonded Logistics Center (Type B).

VI. Enterprise change process of bonded logistics center (Type B)

? ? ? ? If the bonded logistics center (Type B) needs to change its name, address, area and ownership, it shall be accepted by the customs directly under it and reported to the General Administration of Customs for examination and approval. Other changes shall be reported to the customs for record.

VII. Enterprise cancellation process of bonded logistics center (Type B)

? ? ? ? If an enterprise operating a bonded Logistics center (Type B) terminates its business for any reason, the enterprise operating a bonded logistics center (Type B) shall make a written application to the customs directly affiliated to it, handle the cancellation formalities and return the Registration Certificate of Bonded Logistics Center (Type B) after the General Administration of Customs and other relevant departments examine and approve the application.
