Notice of the General Administration of Customs No. 75 of 2022 (Notice on Inspection and Quarantine Requirements for imported Zambian soybean meal)
In accordance with relevant Chinese laws and regulations and the Protocol between the General Administration of Customs, PRC and the Ministry of Agriculture of the Republic of Zambia on Sanitary and Phytosanitary Requirements for Zambian soybean Meal Exported to China, the import of Zambian soybean meal that meets the following requirements is permitted from now on:
I. Basis of inspection and quarantine
(1) Biosafety Law of the People’s Republic of China;
(2) Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine and Regulations for its implementation;
(3) Measures for the Supervision and Administration of Inspection and Quarantine of Import and Export Feed and Feed Additives;
(4) Protocol between the General Administration of Customs of the People’s Republic of China and the Ministry of Agriculture of the Republic of Zambia on Sanitary and Phytosanitary Requirements for soybean Meal exports from Zambia to China.
II. Name of goods allowed to enter the country
The Soybean meal in this proclamation refers to the by-product of Soybean grown in Zambia after crushing and leaching processes to produce separated oil.
III. Enterprise registration
Soybean meal exported to China shall come from processing enterprises approved by the Ministry of Agriculture of the Republic of Zambia (hereinafter referred to as the Zambian side). The processing enterprises shall be recommended by the Zambian side to the General Administration of Customs of the People’s Republic of China (hereinafter referred to as the Chinese side), registered after passing the inspection or examination by the Chinese side, and published on the Chinese website and updated dynamically.
IV. Pests of concern
Soybean meal imported to China shall not carry the following pests of concern to the Chinese side:
1. Acanthoscelides obtectus
2. Trogoderma granarium
3. Phoma glycinicola
4. Acanthospermum hispidum
5. Cuscuta spp.
6. Emex australis
7. Oxalis latifolia
8. Senecio vulgaris
9. Sorghum halepense
10. Striga asiatica
V. The production and export requirements
(1) Production, storage and transportation.
1. Processing enterprises should establish a good hazard analysis and critical control point (HACCP) system, traceability management system and operate effectively, or implement management according to its concept. The Zambian side shall implement effective daily supervision on processing enterprises to ensure that soybean meal exported to China meets the following requirements in the storage, processing and transportation of raw materials and finished products:
- Having relatively enclosed and independent Spaces;
- Take effective measures against rodents, insects and birds to prevent pest contamination.
2. Processing enterprises should strengthen the sanitary control of raw and auxiliary materials, production and processing, storage, transportation and other links to avoid contamination of soybean meal by soil, animal carcasses, animal feces and feathers, and shall not add toxic and harmful substances or any animal-derived ingredients.
3. The packaging bag of soybean meal for export to China should be clean and hygienic without toxic and harmful substances. The means of transport should be thoroughly cleaned and disinfected if necessary.
4. The container or the hold of the ship (if shipped in bulk) carrying soybean meal for export to China shall have at least one package mark indicating the name of the processing enterprise, the registration number and the Chinese and English words of “Zambian soybean meal for export to the People’s Republic of China”. The product label of soybean meal exported to China shall meet the requirements of the Chinese national standard “Feed Label” (GB 10648).
(2) pre-departure quarantine and certificate requirements.
1. Soybean meal that passes the inspection and quarantine is allowed to be exported to China.
2. Each batch of soybean meal imported to China shall be accompanied by a phytosanitary certificate issued by the Zambian party in accordance with the Phytosanitary Certificate Guidelines of the International Standard for Phytosanitary Measures No. 12. As stated in the additional Declaration to the Phytosanitary Certificate:“This consignment complies with the requirements described in the protocol of sanitary and phytosanitary requirements for the export of soybean meal from Zambia to China,and is free from the quarantine pests concerned by China”.At the same time, the processing enterprise name, registration number, container or means of transport number and other information should be indicated. In case of disinfestation treatment before export, information such as disinfestation treatment method and treatment index shall be indicated.
VI. Entry inspection and quarantine
(1) Certificate verification.
1. Check whether the Quarantine Permit for Entry Animals and Plants is attached;
2. Check whether it comes from a registered enterprise;
3. Verify the validity of plant quarantine certificate.
(2) Inspection of goods.
In accordance with relevant laws, administrative regulations, rules and regulations, and in combination with Article 4 and Article 5 of these requirements, the inspection and quarantine of imported soybean meal shall be carried out, and the soybean meal shall be allowed to enter the country after passing.
VII. Handling of non-conformity
(1) If there is no valid phytosanitary certificate, it shall be returned or destroyed;
(2) If live quarantine pests or other live pests are found, they shall be disposed of, returned or destroyed;
(3) If soil or genetically modified ingredients not approved by Chinese authorities are found, they shall be returned or destroyed;
(4) If it is found that it does not meet the requirements of item 4 of paragraph (1) of Article 5, it shall be corrected, returned or destroyed;
(5) If animal feces, animal carcasses, avian feathers, plant seeds or other animal wastes are found that do not meet the relevant safety and health standards of Chinese feed, they shall be destroyed, returned or destroyed in accordance with relevant laws and regulations.
